Terms & Conditions
This is an English translation for convenience. Only the German version is legally binding.
1. Scope & provider
These terms apply to the use of the "Fighter Prime" platform and the services offered through it by Ypsilon Pictures GmbH, Vilbeler Landstraße 203, 60388 Frankfurt am Main, Germany (hereinafter the "provider"). Deviating terms of the user apply only with express consent.
2. Provider's services
- Digital media packages: sale and provision of personal photo/video packages for download (paid).
- Fighter profiles & accounts: free creation and self-management of a public fighter profile.
- Contact/booking brokerage: forwarding of inquiries to fighters (see section 8).
- Advertising: placement of ads for businesses (see section 9).
- Events: submission and display of events by organizers after approval by the provider.
3. Registration & account
Certain functions (e.g. fighter account, contact account) require registration. The user warrants that the information provided is true, keeps their credentials secret and is responsible for activities under their account. The user can have their account deleted at any time. The provider may suspend or delete accounts in the event of misuse or legal violations.
4. User content (profiles, uploads)
The user remains the owner of the content they upload (photos, videos, texts). They warrant that they hold the necessary rights and that publication does not infringe third-party rights (in particular copyright, personality and trademark rights) or statutory requirements. The provider is entitled to remove content that is unlawful or violates these terms. For display on the platform, the user grants the provider a non-exclusive right of use.
5. Conclusion of contract (media packages)
Content and price are shown on the customer's personal page. All prices are final prices including statutory VAT. By selecting a payment method and confirming the purchase, the customer submits a binding offer; the contract is concluded upon confirmation or receipt of payment.
6. Payment & provision
Payment is made by bank transfer or – where offered – via PayPal. After confirmed receipt of payment, the download area is unlocked. Use is for private purposes; sharing the personal access link with third parties is not permitted.
7. Right of withdrawal & rights of use
Consumers have a right of withdrawal; for digital content it may expire early (details see withdrawal policy). The customer receives a non-exclusive, non-transferable right to use the purchased media for private purposes. Commercial use or re-publication requires the prior consent of the provider.
8. Contact & booking brokerage
The provider forwards contact/booking inquiries to fighters and acts solely as an intermediary in this respect. Any contract (e.g. for a booking or an appearance) is concluded exclusively between the inquirer and the fighter. The provider is not a party to the contract, does not owe the conclusion of a booking and is not liable for its performance. Inquiries require prior registration and approval by the provider.
9. Advertising (businesses)
Ad placements are aimed at entrepreneurs. Scope, term and price are agreed separately. The advertising customer warrants that they hold the rights to the advertising material provided and indemnifies the provider against third-party claims. Ads are labeled as "Ad". The provider may reject unlawful or inappropriate advertising.
10. Availability
The provider strives for high availability but does not owe uninterrupted accessibility. Maintenance, disruptions or force majeure may lead to temporary restrictions. Free services may be adjusted or discontinued at any time.
11. Liability
The provider is liable without limitation for intent and gross negligence as well as for injury to life, body or health. In the case of simple negligence, it is liable only for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded. For free services, the provider is liable only for intent and gross negligence.
12. Changes to the terms
The provider may amend these terms with effect for the future, insofar as this is necessary to adapt to changed circumstances and reasonable for the user. Changes will be communicated in an appropriate manner.
13. Final provisions
The law of the Federal Republic of Germany applies. Should individual provisions be invalid, the remainder of the contract remains effective. EU online dispute resolution platform: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
